1The agreement
These terms are a contract between you and Gökay Tuna, operating BOTH. from the United Arab Emirates (the operating company will replace this identity upon incorporation, without reducing your rights). By creating an account or using BOTH., you accept these terms and our Privacy Policy, which is part of this agreement.
2The service
BOTH. is a conversation game for two partners: draw a question, both answer privately, reveal together, and keep what you decide in a shared Ledger. It is a game and a journal — it is not therapy, counseling, medical care, or professional advice, and it makes no clinical claims. If your relationship needs professional support, please seek a qualified professional; BOTH. can accompany that work, never replace it.
3Your account
You need an account, you must be 17 or older, and you are responsible for keeping your sign-in secure and for activity under your account. One person pairs with one partner at a time; pairing requires both partners' action. Information you provide must be accurate.
4Subscriptions, credits, and prices
BOTH. offers free features and paid subscriptions (Duo, Duo+, and optional add-ons such as AI credits and the Vault). Current prices are always shown in the App Store at the moment of purchase and may vary by country and change over time; price changes never apply retroactively to a period you have already paid for. One subscription covers both partners in a couple. Payment is charged to your Apple ID. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel anytime in your App Store account settings. Refunds are handled by Apple under Apple's terms. AI credits are consumed by use, do not expire during an active account, and are not redeemable for cash. If a feature is metered (for example daily AI limits), the limits shown in the app apply.
5AI features
AI-generated follow-up questions require both partners' agreement each time and consume credits (or are included in certain plans). AI output is suggestion, not judgment, advice, or a statement about either of you. We may set fair-use limits to keep the feature available for everyone.
6Your content and our license
Your answers, agreements, and custom questions are yours. You grant us only the limited, non-exclusive license needed to store, transmit, display, and process them so the service can function, under the promises in the Privacy Policy. This license ends when the content is deleted. We claim no ownership of anything you write.
7Acceptable use
Don't use BOTH. to harass, abuse, or impersonate anyone; don't upload unlawful content; don't attempt to access data that isn't yours (including your partner's unrevealed answers — the game's honesty is the point); don't probe, overload, or interfere with the service; don't resell or scrape it. We may suspend or terminate accounts that violate these rules, with notice where reasonable.
8Ending things
You may stop using BOTH. and delete your account at any time, in the app. If either partner ends the couple, the couple's shared data is deleted as described in the Privacy Policy, and each partner keeps a free export of what they personally wrote. Sections that by nature survive termination (your rights to your content, limitations of liability, governing law) survive.
9Disclaimers and liability
BOTH. is provided "as is" and "as available". We work hard to keep it available, accurate, and safe, but we do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for decisions you and your partner make — the conversations, and their outcomes, are yours. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited, and nothing reduces mandatory consumer rights in your country of residence (including under EU consumer law where it applies to you).
10Changes to the service or terms
We may improve, change, or discontinue features. We may update these terms; material changes will be announced in the app or by email before they take effect, and continuing to use BOTH. after a change means you accept it. If you don't accept a change, you may end your account and, where required by law, receive a pro-rated refund of any prepaid period through Apple.
11General
If any provision of these terms is found unenforceable, the rest remain in effect. These terms and the Privacy Policy are the entire agreement between us regarding BOTH. Failure to enforce a provision is not a waiver. You may not assign this agreement; we may assign it to the operating company upon incorporation, without reducing your rights.
12Law and disputes
These terms are governed by the laws of the United Arab Emirates, without prejudice to mandatory consumer protections of your country of residence. If we ever disagree, talk to us first: gokaytuna@gmail.com — most things resolve with a conversation. That is, after all, the premise of the product.
13Languages and availability
These terms are published in English; translations may be provided for convenience, and if they ever differ, the English version prevails. BOTH. is offered in the countries where the app is listed in the App Store; using the service where it is not offered is at your own initiative. Website language availability does not by itself mean the service is offered in every country where that language is spoken.
